These Terms of Use apply to IntervalNest, an iPhone time-lapse frame capture app by Produktyvnist.

By using IntervalNest, you agree to these Terms. If you do not agree, do not use the app.

1. About IntervalNest

IntervalNest is a professional iPhone time-lapse frame capture app that helps users capture timed image sequences and organize them into Nests.

A Nest may contain captured frames, capture settings, metadata, and exports created from those frames.

2. Your Content

You own the photos, frames, videos, and other content you create using IntervalNest.

Produktyvnist Photography Incorporated does not claim ownership of your captured frames, exported videos, or other creative work.

You are responsible for how you capture, use, export, share, back up, or delete your content.

3. Local Storage

IntervalNest is designed as a local-first app.

Captured frames are stored locally on your device inside the app’s storage unless you choose to export, save, share, or delete them.

Raw captured frames are not automatically saved to your Photos library.

You are responsible for managing your device storage and preserving any files you want to keep, including by exporting or backing them up when needed.

4. No Account Required

IntervalNest does not require an account for its core capture features.

5. No Tracking or Advertising

IntervalNest does not include advertising, third-party tracking, or user tracking.

IntervalNest does not sell your data.

6. Capture Conditions

IntervalNest is designed to preserve captured frames and maintain valid Nest data when possible.

However, capture may be affected by device conditions outside the app’s control, including low storage, low battery, heat, camera availability, operating system interruptions, backgrounding, permission changes, hardware limitations, or iOS behavior.

When possible, IntervalNest will preserve frames already saved to a Nest if a capture is stopped or interrupted.

7. User Responsibility During Capture

Time-lapse capture can involve long sessions, large files, battery usage, device heat, and significant storage use.

Before starting a capture, you are responsible for ensuring that your device has appropriate battery, available storage, camera access, and operating conditions for your intended use.

8. Exports

IntervalNest may allow you to create exports, such as videos, from frames saved in a Nest.

Exports are convenience features. The original captured frames remain the source material for your Nest unless you delete them.

Large exports may take time and may be affected by device performance, available storage, file size, image format, frame count, or operating system limits.

9. Acceptable Use

You agree not to misuse IntervalNest or use it in a way that violates applicable laws, infringes the rights of others, interferes with the operation of the app, or attempts to reverse engineer, modify, or abuse the app.

10. App Availability and Changes

Produktyvnist may update, modify, improve, suspend, or discontinue parts of IntervalNest at any time.

We may also update these Terms from time to time. Updated Terms will be posted with a new effective date.

11. No Warranty

IntervalNest is provided “as is” and “as available” without warranties of any kind, to the maximum extent permitted by law.

We work to make IntervalNest reliable, but we do not promise that the app will be error-free, uninterrupted, or suitable for every specific use case, device condition, or production environment.

12. Limitation of Liability

To the maximum extent permitted by law, Produktyvnist is not responsible for lost captures, lost files, missed shots, lost profits, business interruption, device issues, storage limitations, system interruptions, user actions, or other damages arising from the use of IntervalNest.

Nothing in these Terms limits rights that cannot be limited under applicable law.

13. Apple App Store

If you download IntervalNest from the Apple App Store, your use of the app may also be subject to Apple’s applicable terms, conditions, and policies.
